Welcome to A.I.M. ATL!

These Terms and Conditions ("Agreement") govern the services provided by A.I.M. ATL ("Company," "we," "us," or "our") to you, the client ("Client," "you," or "your"). By engaging our direct marketing services, you agree to adhere to the following terms and conditions. Please read them carefully to understand the scope of our services, your obligations as a client, and the performance guarantees we offer.

1. Overview of Services

A.I.M. ATL specializes in delivering cutting-edge direct marketing solutions that focus on achieving measurable outcomes for our clients. We offer the following key benefits as part of our service offering:

  • Increased Return on Investment (ROI): We aim to deliver campaigns that maximize your marketing.

  • Conversion Growth: Our strategies are designed to improve lead generation and conversion rates.

  • Increased Response Rate: We employ proven tactics to enhance audience engagement and response.

  • Timely Execution of Campaigns: We ensure that all agreed-upon marketing activities are executed within the specified timeframes.

While we guarantee these results, there are important conditions under which these guarantees apply, outlined below.

2. Performance Guarantee

A.I.M. ATL guarantees the following performance outcomes, but only under strict adherence to the conditions stated in this Agreement:

  • Increased ROI

  • Growth in Conversion Rates

  • Higher Response Rates

  • On-Time Delivery of Campaigns

Guarantees are valid only if the following conditions are met:

  • The Client provides A.I.M. ATL with full and timely access to necessary platforms, tools, and data required to implement the campaign 

  • The Client does not interfere with ongoing campaigns by making changes to any marketing assets, messaging, or target audiences unless such changes are authorized and approved by A.I.M. ATL.

  • The Client maintains the agreed-upon budget for the duration of the campaign, as any budget cuts may directly affect performance.

3. Client Responsibilities

As a client of A.I.M. ATL, you are responsible for ensuring that all actions required from your side are completed in a timely and efficient manner. Your obligations include but are not limited to:

  • Providing Timely Access: You must ensure that A.I.M. ATL has full access to all relevant accounts, data, and resources necessary to conduct the campaign, including but not limited to CRM systems, email platforms, social media profiles, and analytics dashboards. This access must be provided within a reasonable time after engagement to avoid delays.

  • Adhering to Our Recommendations: We provide expert guidance to optimize your marketing efforts, and it is essential that you implement all recommendations, changes, or actions we propose in the specified timeframes to ensure success.

  • Clear Communication: You are required to respond to all communications from A.I.M. ATL within 48 hours to keep the project moving smoothly. Delayed responses may result in delays in campaign execution and could impact performance outcomes.

  • Avoiding Unauthorized Interference: Once a campaign has been launched, any unauthorized changes made by the Client to the creative, messaging, targeting, or platform settings can undermine the effectiveness of the campaign and void our performance guarantees. Therefore, all modifications must be approved and executed by A.I.M. ATL only.

4. Conditions That Invalidate the Guarantee

Our performance guarantees will not apply in the following circumstances:

  • Client Delays: If there is a delay in providing necessary access, approvals, or feedback, A.I.M. ATL will not be responsible for any resulting underperformance.

  • Client-Implemented Changes: Any changes to the campaigns or assets initiated by the Client that have not been approved by A.I.M. ATL may void the performance guarantee.

  • External Factors: We are not responsible for changes beyond our control, such as sudden shifts in market conditions, economic downturns, or policy updates by third-party platforms

5. Payment Terms

All payments for our services must be made in accordance with the payment schedule outlined in your service agreement. Delays in payment may result in the suspension of services until full payment is made. In the event of non-payment, A.I.M. ATL reserves the right to terminate services without further notice.

6. Termination Policy

Both the Client and A.I.M. ATL reserve the right to terminate this Agreement with 30 days' written notice. Upon termination, the Client will remain responsible for any outstanding fees for services rendered up to the termination date. Any services paid in advance but not yet performed will be refunded on a pro-rata basis.

7. Confidentiality

Both parties agree to maintain the confidentiality of any proprietary or confidential information shared during the course of this engagement. This includes, but is not limited to, trade secrets, business plans, client data, and marketing strategies. Neither party shall disclose any confidential information to third parties without the prior written consent of the other party.

8. Amendments and Modifications

A.I.M. ATL reserves the right to amend these Terms and Conditions at any time. Clients will be notified of any changes via email or other formal communication channels. Continued use of our services following such amendments will constitute acceptance of the revised terms.

9. Governing Law

This Agreement shall be governed by and construed in accordance with the laws of the State of Georgia. Any disputes arising from this Agreement shall be subject to the exclusive jurisdiction of the state and federal courts located in Georgia.
